Notice is hereby given that the PROHIBITED BURNING PERIOD for the Shire of York has been BROUGHT FORWARD to
Midnight on Monday 14th November 2022.
And will commence
15th November 2022 – 14th February 2023
unless otherwise notified.
NO OPEN FIRES ARE PERMITTED DURING PROHIBITED BURNING TIMES

Restricted Burning Times and Permit to Burn requirements.
Do I need a Permit to Burn?
- Pursuant to the Bushfires Act 1954, during Restricted Burning Times a Permit to Burn is required if you wish to conduct any outdoor burning activities.
- The issuing of Permits to Burn seeks to create a balance between the need for landholders to conduct burning activities where required and the need to protect the community from the threat of uncontrolled bushfires.
- A Permit to Burn authorises the holder to conduct a controlled burn adhering to the conditions that are specified within the Permit.
- It is an offence under the Bushfires Act 1954 to fail to abide by the conditions of a Permit to Burn and various sanctions can apply including infringement notices and prosecution.
- If a fire escapes control and Permit to Burn conditions were not adhered in addition to infringements and possible prosecution, third party losses may not be covered by any insurance policy.
- It is an offence under the Bushfires Act 1954 to conduct burning activities without a Permit to Burn during Restricted Burning Times unless an exemption applies.
- During Restricted Burning Times there are exemptions that can apply to small burning activities providing the following conditions are met.

- Piles of burning material need to be less than a cubic metre (1m x 1m wide and 1m high maximum)
- Piles can only be lit after 6pm and must be fully extinguished by midnight.
- The area surrounding the pile must be cleared of all flammable material to a distance of 5 metres all around.
- The exemption does not apply if the Fire Danger Rating is High or above.
- Call the DFES Communication Centre on 1800 198 140 to register the address and expected time of the burn. (This can prevent the Fire Brigade being called out to extinguish your fire if someone mistakenly reports it to 000)
